Welcome to Humboldt.
Humboldt is an emotion-first music journal that helps people capture and revisit how life felt through music.
These Terms of Service ("Terms") govern your use of the Humboldt mobile application, website, and related services ("Humboldt").
By creating an account or using Humboldt, you agree to these Terms.
If you do not agree to these Terms, please do not use Humboldt.
1. Eligibility
Humboldt is not intended for children under 13.
By creating an account, you represent that you are permitted to use Humboldt under the laws applicable to you.
2. Your Account
You are responsible for maintaining the security of your Humboldt account and for activity that occurs through your account.
You agree to provide accurate account information and not to impersonate another person.
You may not sell, transfer, or intentionally provide another person with access to your account.

3. Humboldt Is a Personal Music Journal
Humboldt is designed to help you record and reflect on emotional experiences connected to music.
Humboldt is not a medical, counseling, therapy, mental-health, emergency, or healthcare service.
Information, patterns, insights, or observations presented by Humboldt are intended for personal reflection and should not be treated as medical or professional advice.
4. Your Moments and Content
You retain ownership of the original content you provide to Humboldt.
By adding information to Humboldt, you give Humboldt a non-exclusive, worldwide, royalty-free license to store, process, reproduce, display, and otherwise use that content as reasonably necessary to operate, maintain, secure, improve, and provide Humboldt.
The visibility of your content within Humboldt is governed by the visibility settings and features available to you.
If you choose to make content Public or available to your Circle, you authorize Humboldt to display that content to the audiences you selected.
This license does not transfer ownership of your content to Humboldt.
Certain Moment information may be retained in de-identified form after account deletion as described in the Humboldt Privacy Policy.
5. Public and Circle Content
Humboldt includes features that may allow you to share Moments with other people.
Depending on your selected visibility:
- Private content is intended only for you.
- Circle content may be visible to members of your accepted Circle.
- Public content may be visible to Humboldt users and may appear in public Humboldt experiences, including Humboldt-owned websites.
Do not share information publicly that you do not want others to see.
Humboldt cannot control what another person does with information after that person has legitimately viewed it.
6. Acceptable Use
You agree not to use Humboldt to:
- Violate applicable law or another person's rights
- Harass, threaten, abuse, or intentionally harm another person
- Impersonate another person or misrepresent your identity
- Post content you do not have the right to share
- Infringe copyright, trademark, privacy, publicity, or other legal rights
- Distribute malware or malicious code
- Attempt to gain unauthorized access to Humboldt, another account, or Humboldt's systems
- Interfere with or disrupt Humboldt's operation or security
- Use automated methods to scrape, harvest, spam, or abuse Humboldt
- Use Humboldt for fraudulent or deceptive activity
We may remove content, restrict functionality, suspend accounts, or terminate accounts when we reasonably believe these Terms have been violated or when necessary to protect Humboldt, its users, or others.
7. Music Information and Third-Party Services
Humboldt helps users find and reference music, but Humboldt does not provide a music streaming service and does not claim ownership of third-party music, album artwork, artist names, trademarks, or other music-related intellectual property.
Music information may be provided through third-party services such as Apple's iTunes Search service.
Humboldt may also allow you to open music using services such as Apple Music or Spotify.
Those services are operated independently and are governed by their own terms and privacy policies.
Humboldt is not responsible for the availability, content, pricing, functionality, or policies of third-party music services.
References to third-party products, services, artists, songs, or trademarks do not imply sponsorship or endorsement unless expressly stated.
8. Humboldt Intellectual Property
Humboldt, including its name, branding, original software, interface, design, and original written content, is protected by applicable intellectual-property laws.
Except for rights expressly provided through these Terms, use of Humboldt does not grant you ownership of Humboldt's software, branding, or other intellectual property.
9. Privacy
Your use of Humboldt is also governed by the Humboldt Privacy Policy.
The Privacy Policy explains how information is collected, used, shared, retained, and deleted.

10. Account Deletion
You may delete your account using the Delete Account option in Humboldt's Settings.
If you cannot access the app, you may request deletion by emailing:

We may verify ownership of the account before processing an emailed request.
Account deletion is permanent once completed.
Certain information may remain in de-identified or aggregate form as described in the Humboldt Privacy Policy.
11. Changes to Humboldt
Humboldt will continue to evolve.
We may add, modify, replace, or discontinue features from time to time.
We may also temporarily restrict access when necessary for maintenance, security, legal compliance, or technical reasons.
We do not guarantee that every feature will always remain available or operate without interruption.
12. Suspension or Termination
You may stop using Humboldt at any time.
We may suspend or terminate access when reasonably necessary because of:
- Violation of these Terms
- Security concerns
- Fraudulent or abusive activity
- Legal requirements
- Conduct that creates risk for Humboldt or other users
Where appropriate and practical, we may provide notice before taking action.
13. Disclaimer
Humboldt is provided on an "as available" basis.
While we work to provide a reliable and useful experience, we cannot guarantee that Humboldt will always be uninterrupted, error-free, secure, or available.
To the extent permitted by applicable law, Humboldt disclaims warranties that are not expressly provided in these Terms.
Nothing in these Terms limits rights that cannot legally be waived.
14. Limitation of Liability
To the extent permitted by applicable law, Humboldt and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use Humboldt.
Nothing in these Terms excludes or limits liability where doing so would not be permitted by law.
15. Changes to These Terms
We may update these Terms as Humboldt changes.
When we make changes, we will update the "Last updated" date at the top of this page.
If changes materially affect your rights or obligations, we will make reasonable efforts to provide additional notice.
